Terms of Service

These terms govern your use of the PataEstate app and website. By creating an account you agree to them. If you do not, do not use the service.

1. What PataEstate is
PataEstate flips the property search. Seekers post what they are looking for; landlords and agencies see that demand and respond with matching properties. We introduce the two sides and we get out of the way.
We are not an estate agent, a broker, a landlord or a party to any tenancy or sale. We do not own, inspect, value or manage any property on the platform. We do not hold deposits, rent or purchase money, and we are not part of any agreement you reach with the other side.
2. Who may use it
You must be 18 or over and able to enter a binding contract. One person, one account. You are responsible for what happens under your account and for keeping access to the Google or Apple account you sign in with.
3. Posting a request
- Describe a home you are genuinely looking for. Requests are for real searches, not tests, jokes or market research.
- Keep it accurate. A budget or move-in date you have invented wastes the time of people who answer in good faith.
- Do not put phone numbers, email addresses or messaging handles in free text. The app will refuse them. Withholding your contact details is what stops forty agents cold-calling you in an hour, and it only works if it is enforced.
- Requests expire automatically 14 days after posting. Post again if you are still looking.
4. Listing a property
If you use the supply side, then for every property you put on PataEstate:
- It must be real, currently available, and something you have the right to market.
- The price, location, size and features must be accurate, and the photos must be of that property.
- Withdraw it promptly once it is gone. A listing that is no longer available and is used to pull in enquiries is a bait listing, and it will get your account removed.
- If you connect an EstateBax account, you confirm you are authorised to act for that agency and to bring its inventory here.
5. Contacting seekers
A seeker's identity and contact details are withheld until they choose to answer you. You may respond to a request only through PataEstate. Any attempt to identify, contact or trace a seeker outside the platform is a serious breach of these terms and will end your access.
6. What you may not do
- Discriminate. Do not refuse, filter, price or word an offer on the basis of ethnicity, race, religion, gender, age, disability, pregnancy, marital status or any other protected characteristic.
- Harvest, scrape, bulk-export or resell data from the platform, by hand or by machine.
- Impersonate anybody, or claim an agency, licence or verification you do not hold.
- Post anything unlawful, fraudulent, abusive, or infringing someone else's rights.
- Probe, overload or interfere with the service or the accounts of other users.
- Charge a seeker a fee to be shown properties or to have their request answered.
7. Matches are not endorsements
A match means our system judged a property to fit a request. It is not advice, a recommendation or a guarantee. We do not verify properties, ownership, titles, licences or the identity of anyone on the platform.
Where the app shows a phone as "verified", that means exactly one thing: an SMS code was delivered to that number and entered back. It says nothing about who the person is, whether they are licensed, or whether the property is theirs. A profile "star" reflects how complete a profile is, not how trustworthy someone is.
Check everything before you pay anybody anything. View the property. Confirm ownership. Never send money to someone you have not met for a property you have not seen.
8. Your content
What you post stays yours. By posting it you give us the permission we need to run the service: to store it, display it to the relevant side of the marketplace, and process it for matching. That permission ends when you delete the content or your account, except for copies already retained in backups or required by law.
You must own or have the right to post everything you upload, photos included.
9. Availability
PataEstate is under active development and is provided "as is". We do not promise it will be uninterrupted, error-free, or that any request will receive a single reply. Features may change or be withdrawn.
10. Liability
To the fullest extent the law allows, we are not liable for any loss arising from a transaction, agreement or dealing between users; from the accuracy of anything a user posts; from any property you view, rent or buy; or from any lost data, profit or opportunity. Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence.
11. Suspension and termination
You may delete your account from inside the app at any time. We may suspend or remove an account that breaches these terms, that puts other users at risk, or that we are required to remove by law — and where we can do so fairly, we will tell you why.
12. Changes to these terms
We may update these terms. The date at the top changes when we do, and we will notify you in the app before a material change takes effect. Continuing to use PataEstate after that means you accept the new terms.
13. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from them.
